Resident Magistrate Semi Babitu has dismissed the request made by Zarin Khan’s legal representatives to lift the Stop Departure Order enforced by the Fiji Independent Commission Against Corruption (FICAC). Khan, who is associated with Aliz Pacific, sought permission to travel abroad for medical reasons.
In opposing the request, FICAC Principal State Counsel Lilian Mausio argued that the court lacked the authority to consider the case, highlighting that the applicant’s request was flawed. Since Khan has not faced any formal charges, Mausio noted that the relevant provisions of the Criminal Procedure Act were not applicable.
In his ruling, Magistrate Babitu affirmed that the court could not entertain Khan’s application, clarifying that the Stop Departure Order was properly issued by the FICAC Commissioner in accordance with the FICAC Act.
