Prominent Suva lawyer Isireli Fa is calling on the government to prioritize the involvement of experienced lawyers, particularly those familiar with iTaukei institutions that handle sensitive traditional matters. This appeal follows a significant court ruling affirming the rightful claim to the chiefly title of Tui Nadi after a lengthy legal battle that lasted over three decades.
Fa represented a group from Narawa Nadi, which challenged decisions made by the iTaukei Lands Appeal Tribunal and the iTaukei Lands and Fisheries Commission regarding the Tui Nadi title. The court recently ruled in their favor, a decision Fa considers a critical victory within the complex landscape of indigenous land rights in Fiji.
The ruling underscores the importance of legal expertise in proceedings involving traditional leadership and titles. Fa emphasized that inexperienced lawyers can inflict significant trauma on individuals involved in such matters, worsening the emotional toll of already challenging disputes. “We need the best people on these cases to ensure fair resolutions,” Fa stated, urging the Minister and the Attorney General to reorganize their legal teams.
Ratu Asiveni Dawai, who has fought for his family’s rightful claim to the title, reflected on the long journey toward justice, noting that many who fought for the truth did not live to see the final outcome. However, he expressed gratitude to Fa and his legal team for their unwavering support over the years.
This case is indicative of broader discussions surrounding the authority of iTaukei institutions and the viability of legal routes for appealing their decisions. Past misinterpretations of the commissions’ powers have led to numerous unresolved disputes, illustrating a need for reform in how traditional matters are approached legally.
Overall, this ruling not only marks a crucial legal victory but also represents a hopeful step toward enhancing the integrity and functionality of the iTaukei judicial system. There is optimism that as similar cases arise, they may catalyze lasting change that honors both traditional practices and legal frameworks, fostering a more equitable future for indigenous rights in Fiji.
