Legal Shuffle: New Deputy DPP Appointment Sparks Controversy

Attorney-General Graham Leung has confirmed the appointment of John Rabuku as the new deputy Director of Public Prosecution (DPP). This announcement follows Rabuku’s recent departure from the acting DPP role, which he held for five weeks.

The appointment was revealed by acting DPP Nancy Tikoisuva on Wednesday. Last month, Leung had advised Rabuku to step down from the acting DPP position after the Supreme Court deemed his appointment “ineligible.”

Leung stated, “Under the Constitution, the DPP is empowered to appoint his/her own staff.” He emphasized that decisions regarding staff appointments rest solely with the DPP or the acting DPP, and do not require input or approval from the Judicial Services Commission or the Attorney-General.

Additionally, Leung pointed out that if the acting DPP takes a leave of absence, it does not automatically mean that the deputy will take over the responsibilities.
