Legal Shake-Up: Who’s Next in the DPP’s Office?

The Attorney-General, Graham Leung, has recognized John Rabuku’s appointment as the new deputy Director of Public Prosecution (DPP). This announcement follows Rabuku’s departure from his role as acting DPP five weeks prior. Acting DPP Nancy Tikoisuva confirmed Rabuku’s new position on Wednesday.

Last month, Leung requested Rabuku to step down from the acting DPP role after the Supreme Court deemed his appointment “ineligible.” Leung emphasized that under the Constitution, only the DPP has the authority to appoint their staff. He noted that such decisions are made solely by the DPP or the individual acting in that capacity, and not by the Judicial Services Commission or the Attorney-General, underscoring that there was no legal necessity for consultation or approval from him.

Additionally, Leung explained that if the acting DPP were to take a leave of absence, it does not automatically follow that the deputy would take over those duties.
