Law Society Urges Acting Director of Public Prosecutions in Fiji to Resign

The Fiji Law Society (FLS) is calling for the immediate resignation of Acting Director of Public Prosecutions, John Rabuku.

In a letter signed by FLS president Wylie Clarke, the organization emphasized that Rabuku should step down to show his respect for Fiji’s laws and the courts established under those laws.

On June 28, 2024, the Supreme Court of Fiji issued a unanimous opinion on a matter referred by the Cabinet under section 91 of the Constitution. The case, a rare event involving the Cabinet seeking legal guidance from the Supreme Court, highlighted the deference even the highest authorities in the country have for the Supreme Court’s legal expertise.

The Supreme Court ruled that Rabuku was disqualified from serving as Acting Director of Public Prosecutions according to the Constitution. Given this clear ruling, the FLS is highly concerned that Rabuku continues to hold the office.

Rabuku has been quoted in local media as stating that he will not resign and will instead await formal communication from the Cabinet or Judicial Services Commission.
