Justice Temo: Natural Justice for DPP Pryde Amidst Ongoing Allegations

The Judicial Services Commission (JSC) has decided to grant full salary to Christopher Pryde, the Director of Public Prosecutions (DPP) in Fiji, as he prepares for his return to office. Initially set to resume his duties on January 20, 2025, Pryde has opted to delay his return until February 3, 2025, to respond adequately to allegations made against him by Acting DPP Nancy Tikoisuva.

JSC Chairman and Chief Justice Salesi Temo stated that the commission met recently and, in accordance with principles of natural justice, has provided Pryde with the required details of the allegations and requested a formal response within 14 days. As a result, he will remain on paid leave during this period.

Justice Temo acknowledged the ongoing investigation by the Fiji Independent Commission Against Corruption (FICAC) and emphasized that the JSC will refrain from public comments related to the investigation until further developments occur. The JSC, Temo said, will carefully assess Pryde’s response before making additional decisions.

This situation follows a previous tribunal ruling that cleared Pryde of past misconduct allegations, which underscored the importance of due process within Fiji’s legal framework. The tribunal’s decision sheds light on the definition of “misbehaviour” as outlined in the Fijian Constitution, potentially influencing future complaints against judicial officials.
