Justice Praises Witness Integrity in High-Profile Inquiry

Justice David Ashton-Lewis has expressed admiration for the honesty of witnesses involved in the Commission of Inquiry concerning the appointment of Barbara Malimali as Commissioner of the Fiji Independent Commission Against Corruption (FICAC). During a media briefing, he noted that traditionally, in court settings, individuals strive to provide truthful accounts. “Very rarely do you find liars, but you do occasionally,” he remarked, emphasizing that there has been no indication of deception among witnesses so far.

Justice Ashton-Lewis explained that logistical challenges have led some witnesses to testify virtually, particularly those unable to travel from countries like New Zealand and Australia. He stated, “Our job is to get their evidence and to do what we can to assist,” allowing participants the choice to attend either in person or online.

Senior Barrister Janet Mason highlighted the necessity for a revision of the timeline for the commission’s report submission, stating that the duration of witness testimonies was longer than expected. She underscored the importance of fair procedures, ensuring that those who might be affected by the inquiry have sufficient opportunity to express their concerns.

The inquiry is scheduled to hear from former President Ratu Wiliame Maivalili Katonivere today, marking a significant step in the exploration of political accountability regarding Malimali’s appointment. This inquiry seeks to validate the legality and integrity of Malimali’s role in light of wider issues surrounding governance within the FICAC.
