“Judicial System Overhaul: Major Changes Coming Soon”

The Office of the Attorney General has received the Civil Rules Review Report from Acting Chief Justice Salesi Temo last month.

The report was compiled by the Civil Division Rules Committee, which includes judges and magistrates and is chaired by Justice Anare Tuilevuka.

Charged by Acting Chief Justice Salesi Temo, the Civil Division Rules Committee was tasked with evaluating the existing High Court and Magistrates Court Rules to improve case management.

Concerns over persistent delays in the civil justice system, which erode public trust in the Judiciary, prompted this review.

The review of the Civil Court Rules aims to address one of the primary reasons behind these delays.

The Civil Rules Review Report identifies issues with the current High Court and Magistrates Court Rules and proposes solutions based on the experience of judicial officers.

Recommendations include shortening timelines for applications and determinations, holding pre-trial conferences with judicial officers at the first hearing, and implementing mandatory mediation.

Before presenting the draft amendments, the Office of the Attorney General, through the Director of the Law Reform Commission, will hold further consultations with stakeholders and the public.
