Inquiry Under Scrutiny: Who’s Protecting Witnesses in Fiji?

The Commission of Inquiry (COI) is set to meet with Prime Minister Sitiveni Rabuka following an email raised by FICAC Commissioner Barbara Malimali. This correspondence expresses her concerns regarding the access former investigations manager Kuliniasi Saumi had to critical documents relevant to the inquiry just before his upcoming testimony. Malimali was placed on leave last week by the Judicial Services Commission.

In her email to her legal representatives and the COI, Malimali pointed out that around 40 other investigators could provide the necessary documents, emphasizing her worries about the direction the COI is taking. According to Counsel Assistant Jane Mason, while the committee has not yet responded to Malimali’s email, she plans to forward it to the Acting Deputy Commissioner to seek assurance for witness protection.

The ongoing concerns come in the context of the COI’s aims to uphold the integrity of the inquiry and protect witnesses after Saumi’s unexpected dismissal, which many view as intimidation. Mason noted that Malimali’s continued involvement, even while on leave, could jeopardize the safety of witnesses and undermine the inquiry’s credibility.

As the investigation progresses, the COI is scheduled to conclude its findings next week, pending the testimony of Chief Registrar Tomasi Bainivalu, who is currently overseas. This inquiry not only sheds light on the issues within Fiji’s governance and accountability structures but also possesses the potential to initiate significant reforms.
