Inquiry Launched: Was FICAC’s New Commissioner Appointed Legally?

A Commission of Inquiry has convened at the Old Parliamentary complex in Veiuto, Suva, to evaluate the legality of the appointment process for Barbara Malimali as the Commissioner of the Fiji Independent Commission Against Corruption (FICAC). The two-week inquiry began today with Prime Minister Sitiveni Rabuka testifying as the first witness due to his role as chairman of the Constitutional Offices Commission.

This inquiry, overseen by Supreme Court Judge Justice David Aston-Lewis, aims to investigate potential improper or unlawful influences in Malimali’s appointment on September 5, 2024. The Commission’s Terms of Reference includes examining whether vested interests, particularly around ongoing FICAC cases involving high-profile figures such as Members of Parliament and public servants, played a role in the process.

The hearings will run until January 16, featuring 34 witnesses, including key political figures like Deputy Prime Ministers Professor Biman Prasad and Manoa Kamikamica, former Women’s Minister Lynda Tabuya, Opposition Leader Inia Seruiratu, and Attorney-General Graham Leung. Suva attorney Tanya Waqanika is representing Malimali in the proceedings.

The final report from this inquiry is anticipated to be submitted to the President and Prime Minister on January 31, 2025.
