High Court to Hear Controversial Compensation Claims in Historic Case

The High Court in Suva has scheduled a hearing regarding the application to strike out claims made by former Director of Public Prosecutions, Neelraj Sharma. This application is connected to compensation claims amounting to $800,244 from Veronica Malani, aimed at 11 individuals involved in the 2020 investigation of an alleged bombing incident from 1987.

During a court session held on Wednesday under Justice Usaia Ratuvili, all attorneys were present. Sharma’s attorney, Ronal Singh, expressed their readiness to proceed with setting a hearing date; however, Malani was granted additional time to ensure her lawyer, Sitiveni Raikanikoda, could attend.

Justice Ratuvili has set the hearing for December 11, with all parties expected to submit their arguments prior to this date. In court, Mr. Raikanikoda raised concerns regarding the defense’s adherence to civil procedure, noting the lack of a filed statement of defense after the issuance of the writ of summons. Instead, the defense opted to file a strike out application.

He also addressed the representation of former acting Police Commissioner Rusiate Tudravu and retired Assistant Police Commissioner Biu Matavou, who are the fifth and sixth defendants, respectively. Raikanikoda questioned their representation by the Office of the Attorney-General, given their status as retired government employees, and asked if they should also have their own legal representation for the case. Justice Ratuvili responded that, regardless of their appearance, the trial would proceed.
