High Court Ruling: Tevita Kapawale’s Bail Denied Amid Murder Charges

Tevita Kapawale, who is accused of multiple murders, has had his bail application rejected by the Suva High Court. During a court appearance before Justice Dane Tuiqereqere, Kapawale faced five murder charges, one count of attempted murder, and one count of intimidation.

The allegations against him involve the deaths of three Indonesians and two Fijians aboard the FV Tiro 2 on May 18, 2021, following a confrontation among crew members. This was Kapawale’s second request for bail, wherein he argued that being released would allow him to work and support his family financially.

Justice Tuiqereqere cited Kapawale’s previous failures to appear in court on two occasions as a significant concern. Although Kapawale eventually surrendered after a bench warrant was issued, the judge noted that this did not excuse his prior absences.

The trial for the case is set to commence in January, and Justice Tuiqereqere expressed concerns that Kapawale might not return for the proceedings if he were to be granted bail. While acknowledging the principle of presumed innocence, the judge emphasized the gravity of the charges and the compelling evidence against Kapawale. He also pointed out that, if convicted of murder, Kapawale could face a life sentence.
