High Court Ruling Delays Key Evidence in High-Profile Murder Case

The High Court in Suva has sided with murder suspect Tevita Qaqa Kapawale by blocking the return of three satellite beacons to the owners of the ship linked to the alleged crimes. The Office of the Director of Public Prosecutions had requested Justice Dane Tuiqereqere to release the beacons from police custody, where they have been held as evidence for the last three years, to allow the ship’s company to utilize them on a new vessel.

DPP lawyer Triveshni Sharma argued for the release, emphasizing the company’s need for the beacons. However, Mr. Kapawale, supported by his legal counsel, strongly opposed this move. He contended that giving back the beacons would hinder his defense, as he would not have access to them during his upcoming trial, slated to start in January of next year.

Mr. Kapawale faces serious charges, including five counts of murder and additional charges of attempted murder and criminal intimidation. The alleged incidents date back to 2021, claiming the lives of five crew members, comprising three Indonesian nationals and two Fijians, while also putting two other locals in a position of threat.

The case has been adjourned until December 13, leading up to the trial, which will address these grave allegations.

This ruling underscores the importance of ensuring that defendants have fair access to evidence crucial for their defense in legal proceedings. It is essential for the integrity of the judicial process that all parties involved are given a fair opportunity to present their cases.
