Tevita Kapawale, accused of multiple murders, has been denied bail by the Suva High Court. The court session, led by Justice Dane Tuiqereqere, addressed five murder charges, an attempted murder charge, and one count of intimidation against Kapawale.
The allegations involve the deaths of three Indonesians and two Fijians during an incident on the FV Tiro 2 on May 18, 2021, amid tensions among crew members. This marks Kapawale’s second attempt to secure bail; he argued that he requires the freedom to work and support his family financially.
However, Justice Tuiqereqere highlighted that Kapawale had previously failed to appear in court twice. Although he did surrender following a bench warrant, the judge noted that this did not excuse his prior absences. The trial has been set for January, with the judge expressing concern over the likelihood of Kapawale returning for it if released on bail.
While acknowledging the principle of presumption of innocence, Justice Tuiqereqere emphasized the gravity of the charges and the substantial evidence against Kapawale. He also warned that a murder conviction could result in a life sentence for the accused.
