The High Court in Suva has scheduled a hearing for December 11 regarding the motion to strike out presented by former Director of Public Prosecutions, Neelraj Sharma. This application pertains to compensation claims amounting to $800,244 made by Veronica Malani against 11 defendants linked to the investigation of the alleged 1987 bombing case, which surfaced again in 2020.
During a recent proceeding, all attorneys were present before Justice Usaia Ratuvili. Sharma’s legal representative, Ronal Singh, indicated their readiness for a hearing; however, Malani was granted additional time to ensure that her lawyer, Sitiveni Raikanikoda, could attend.
Mr. Raikanikoda raised concerns in court regarding the defense’s failure to adhere to civil procedure protocols. He noted that none of the defense lawyers had submitted a statement of defense after the writ of summons was issued, opting instead to file a strike-out application directly. He also questioned the legal representation of retired government officials Rusiate Tudravu and Biu Matavou, who are among the defendants, suggesting they should secure a separate legal representative given their inclusion in the lawsuit.
Justice Ratuvili remarked that the trial would proceed regardless of their appearance at this juncture.
This case highlights ongoing legal complexities surrounding historical events and the importance of procedural integrity in legal proceedings.
