Future of Occupational Health and Safety: Still Up in the Air?

The government has yet to make a decision regarding the potential separation of the Occupational Health and Safety (OHS) Department from the Ministry of Employment, Productivity, and Workplace Relations.

During a recent ministry meeting on the review of the 2022 Audit Report concerning the General Administration Sector, permanent secretary for Employment, Maritino Nemani, indicated that discussions surrounding this issue are ongoing.

Nemani noted, “There have been discussions within the ministry about this matter. However, it is ultimately a political decision that my minister will make through the appropriate processes.” He emphasized the need for the government to take responsibility for the OHS rather than allowing it to operate as a standalone entity.

He also highlighted an urgent need to review existing OHS regulations, indicating that the attention is currently focused on updating certain laws. “We are prioritizing the review of our legislation, specifically the OHS regulations,” Nemani stated. “This task is being coordinated through the offices of the Attorney-General and the Solicitor General, and will be addressed prior to considering any structural changes within the ministry.”

Nemani expressed the significance of these legislative updates, noting their impact on business operations, trade, and inter-ministerial linkages. He acknowledged that while the decision about the OHS’s administrative structure remains pending, it is a critical issue that requires careful consideration, especially concerning accountability.
