The Suva Magistrate’s Court has issued a bench warrant for Isikeli Komaisavai, the former vice-president of the Nasinu constituency for the Social Democratic Liberal Party (SODELPA), after he failed to appear for his scheduled hearing on Thursday. Komaisavai, aged 52, faces charges of causing harm through electronic communication.
The charge stems from an incident on February 10, 2021, when Komaisavai allegedly made a Facebook post suggesting violence against then-Attorney-General Aiyaz Sayed-Khaiyum, implying that he should be killed. During the court proceedings, prosecutor Sharmila Lata informed Magistrate Jeremaia Savou that all witnesses were present in court; however, Komaisavai was noticeably absent. Lata subsequently requested the court to allow the trial to proceed without the defendant, which was approved.
Notably, one of the key witnesses for the prosecution is Mr. Sayed-Khaiyum himself, who has been summoned to provide testimony against Komaisavai. The court has adjourned the case to December 17, when a judgment will be delivered.
This situation highlights the importance of accountability in public discourse, particularly in the digital age, where words can lead to significant consequences. The upcoming judgment will not only determine Komaisavai’s fate but may also set a precedent for how such cases are handled in the future, encouraging more responsible communication online.
Overall, while the case presents serious charges, it serves as a reminder of the need for mindfulness in speech and engagement in political discussions. The legal process will ensure that justice is served, providing an opportunity for discourse to be conducted in a more constructive and respectful manner.
