Former Attorney General’s Bail Variation Application Denied: What’s Next?

The Magistrates Court in Suva has denied the request to review the bail variation case of former Attorney General Aiyaz Sayed-Khaiyum, with the decision being made by Resident Magistrate Yogesh Prasad.

In June, Magistrate Prasad turned down Sayed-Khaiyum’s request for a bail variation to travel to Singapore for medical reasons, stating it was neither essential, necessary, nor urgent.

Suva lawyer Davenesh Sharma had sought a bail variation in a case where Sayed-Khaiyum is charged along with former Prime Minister Voreqe Bainimarama and former Health Minister Dr. Neil Sharma.

The Court decided not to rule on the case before Magistrate Prasad, noting that the bail decision made by him should be handled by the magistrate currently presiding over the matter.

Magistrate Sufia Hamza emphasized that any applications related to bail must be addressed by the magistrate handling the original case, who is still presiding in the Suva Magistrate’s Court.

The case has been adjourned to Monday, 5 August, for a hearing on the bail application.

The former Attorney General was excused from today’s ruling after falling ill during yesterday’s hearing.
