Fiji’s Inmate Communication Crackdown: Are You Breaking the Law?

The Fiji Correction Services (FCS) has reiterated its warning to the public regarding the ban on unauthorized communication with inmates, but the reminder appears to have been ignored by many. Commissioner Dr. Jalesi Nakarawa informed that the agency is reviewing its policies and may take legal steps against those who communicate with prisoners without proper approval.

Currently, the Corrections Act does not provide a mechanism to pursue legal action against the public for such unauthorized interactions. However, Dr. Nakarawa stated that the FCS is considering making unauthorized communication an offense, which would require amendments to the existing legislation in collaboration with the Fiji Law Reform Commission and the Solicitor General.

He urged the public to be aware of the challenges faced by corrections officers when managing inmates and to avoid any unauthorized contact. Although disciplinary measures can be enforced on inmates, potentially extending their sentences, the FCS is seeking a more structured resolution that enables law enforcement to charge individuals who violate communication protocols. The agency emphasizes the need to carefully assess the implications of these changes while striving to maintain security, legal compliance, and fair treatment for all parties involved.
