Fiji’s Employers Demand Transparency in Job Legislation Consultations

The Fiji Commerce & Employers Federation (FCEF) has expressed serious concerns about the upcoming public consultations regarding two significant pieces of legislation—the Employment Relations Act 2007 and the Work Care Bill 2024. Scheduled to take place from January 8 to January 17, the FCEF considers the timeline for these consultations to be insufficient, hindering meaningful engagement from the public, businesses, and workers.

FCEF Chief Executive Edward Bernard has called for the Permanent Secretary of the Ministry of Employment, Productivity & Workplace Relations (MEPWR) to postpone the consultations until early February 2025. He argues that this delay would allow adequate time for stakeholders to review and prepare, particularly emphasizing the need for transparency through the release of the draft bills. The FCEF believes that the absence of these documents limits engagement and could negatively influence investor confidence and job opportunities.

In a letter addressed to the Permanent Secretary, Bernard pointed out the inadequacy of the three-hour time frame allotted for each city and town, arguing that such a brief period is unrealistic for businesses to adequately represent their members. He highlighted the challenges many businesses in the Western Division are currently facing due to recent floods, making it impractical to expect them to prepare submissions by the early January deadline.

Bernard stated that rushing these important legislations compromises the interests of workers, businesses, and even the government as an employer. He also remarked on the lack of discussion surrounding the Work Care Bill 2024 within the Employment Relations Advisory Board (ERAB), stating that employers have not had any input or insight into the bill’s content or its implications on the Employment Relations Act.
