Fiji’s DPP Cleared: A Landmark Ruling on Misbehaviour Claims

A tribunal established under Fiji’s Constitution has concluded that Mr. Christopher Pryde, the Director of Public Prosecutions (DPP), is not guilty of any misbehavior, thus negating the basis for his removal from office. The tribunal, chaired by Justice Anare Tuilevuka and joined by Justices Chaitanya Lakshman and Samuela Qica, submitted its findings to President Ratu Naiqama Lalabalavu on December 23, 2024. After a thorough review and consultations, the President endorsed the tribunal’s unanimous decision.

Key findings of the tribunal include:

– No evidence was found to support allegations against Mr. Pryde.
– The report provided clarity on the term “misbehavior,” which lacked a definition in Fiji’s Constitution.
– Recommendations were made for the Judicial Services Commission (JSC) to implement clearer policies and frameworks for managing complaints against judicial and quasi-judicial officials, thereby promoting transparency and accountability.

In light of these findings, Mr. Pryde’s return to his role will proceed with the following actions:

1. The reinstatement of Mr. Pryde’s 2019 Agreement of Service with the Government.
2. Immediate repayment of any unpaid salary and benefits owed to him.
3. Mr. Pryde will coordinate with the Chairperson of the Judicial Services Commission to ensure a smooth transition back into his duties, including the return of official materials.
