Fiji’s Corruption Commissioner Appointment Sparks Controversy

The appointment of Barbara Malimali as the Commissioner of the Fiji Independent Commission Against Corruption (FICAC) has drawn criticism from Senior Opposition MP Jone Usamate, who describes the decision as misguided and inappropriate. While he supports the advancement of women into vital roles, he raised concerns about the implications for transparency and accountability within the commission.

Usamate questioned whether the Judicial Service Commission (JSC) undertook appropriate measures in the hiring process, specifically regarding the engagement of an independent team to assess candidates, as is standard for such appointments. He emphasized the JSC’s responsibility to uphold public trust in independent institutions, suggesting that even qualified individuals like Malimali should have their appointment scrutinized, particularly since she received a high score of 141 from Acting Chief Justice Salesi Temo.

Further, he challenged whether due diligence was properly conducted by the Office of the President regarding Malimali’s suitability, especially in light of an ongoing investigation involving her. Usamate argued that, as chair of the Electoral Commission, it should be confirmed whether she has officially resigned and met necessary notification requirements.

He also raised serious concerns over a potential misuse of power related to acting Deputy Commissioner Francis Puleiwai allegedly being instructed not to file formal charges against Biman Prasad. Usamate called for an immediate independent investigation, potentially led by the police, to address these issues.

Usamate emphasized the importance of good governance as a cornerstone of effective government in Fiji, expressing disbelief at comments made by the Minister of Justice regarding investigations into Cabinet Ministers being labeled as “acts of malice.” He questioned if some individuals in the country are above scrutiny, echoing sentiments on equality and accountability in governance.
