Fiji’s Constitution Under Review: What Changes Might Come?

The review of the 2013 Constitution is officially underway. This decision was highlighted in the newly launched 2025-2029 National Development Plan (NDP) by Deputy Prime Minister Manoa Kamikamica.

The NDP emphasizes the need to enhance the regulatory and legal framework, as well as improve collaboration among law and order agencies to ensure the safety, security, and wellbeing of Fiji and its citizens. Key components of the NDP include:

– The review of the 2013 Constitution of the Republic of Fiji.
– The promotion of the rule of law at both regional and international levels, ensuring equal access to justice for everyone.
– The examination of legislation governing law enforcement agencies to guarantee transparency and efficiency.
– The assurance of separation and independence among the three branches of government: the Legislature, Executive, and Judiciary.
– The enhancement of capacity and expertise within the Office of the Attorney-General, including its legislative drafting division, the Law Reform Commission, and the Fiji Intellectual Property Office.
– The elimination of discrimination and the restriction of arbitrary misuse of the broad discretionary powers of laws.
– The establishment of safeguards against the misuse of discretionary powers and the removal of provisions that limit judicial review of the administrative discretionary powers granted to Ministers and public officials.
– The revision of constitutional procedures to seek amendments that uphold the independence of key institutions such as judicial commissions, the Fijian Elections Office, and the Reserve Bank of Fiji, along with other fiduciary institutions.
– The implementation of the Fiji Protective Security Framework to protect institutions.
– The enhancement of coordination among security and rehabilitation agencies.
– The assurance of public access to information and the protection of fundamental freedoms, aligning with national legislation and international agreements, including the allocation of sufficient human resources for institutions.
