Fiji’s Constitution Set for a Major Overhaul!

The review of the 2013 Constitution is officially set in motion. This decision was announced during the launch of the 2025-2029 National Development Plan (NDP) by Deputy Prime Minister Manoa Kamikamica.

The NDP emphasizes the importance of enhancing the regulatory and legal framework to ensure the safety, security, and welfare of Fiji and its citizens. Key initiatives outlined in the plan include:

– A review of the 2013 Constitution of the Republic of Fiji.
– Promotion of the rule of law at both regional and international levels, ensuring equal access to justice for all.
– Reassessment of all legislation governing law enforcement agencies to enhance transparency and efficiency.
– Assurance of the separation and independence of the three branches of government – the Legislature, Executive, and Judiciary.
– Augmentation of capacity and expertise within the Office of the Attorney-General, particularly in its legislative drafting division, the Law Reform Commission, and the Fiji Intellectual Property Office.
– Elimination of unfair discrimination and prevention of arbitrary misuse of broad discretionary legal applications.
– Implementation of safeguards against the misuse of discretionary powers and the removal of provisions that impede judicial review of administrative discretion granted to ministers and public officials.
– Revision of all constitutional processes with an aim to amend provisions that ensure the independence of key institutions such as judicial commissions, the Fijian Elections Office, the Reserve Bank of Fiji, and other fiduciary bodies.
– Execution of the Fiji Protective Security Framework to fortify institutions.
– Enhancement of cooperation among security and rehabilitation agencies.
– Assurance of public access to information and the safeguarding of fundamental freedoms in line with national laws and international agreements, alongside appropriate allocation of human resources within institutions.
