Fiji’s Bold Move: Revamping Housing Laws for a Fair Future

The Fijian Cabinet has approved a review of the Development of Informal Settlements Act 2022, aiming to improve the legislation’s effectiveness in addressing the country’s growing informal housing challenges. Originally designed to create a systematic approach for the development, relocation, and upgrading of informal settlements, the Act is now being evaluated to better align with current social justice and human rights principles.

The review is expected to scrutinize certain provisions identified as needing clarification and enhancement to ensure fairness, equity, and transparency in the processes related to relocation and development. This move highlights the government’s commitment to tackling the issues faced by informal settlements, which house a significant portion of the population—around 20% or over 200,000 individuals, as noted by Opposition Member Parveen Bala in recent parliamentary discussions. These areas often lack basic amenities and are associated with higher poverty levels, currently standing at 29.9%.

Minister for Housing and Local Government Maciu Nalumisa acknowledged the challenges that have persisted through previous administrations, with only three settlements having been formalized so far. He emphasized a long-term 12-year plan aimed at methodically addressing these critical issues in partnership with various stakeholders, including the iTaukei Land Trust Board, while seeking community involvement.

This legislative review is part of a broader initiative that includes a budget allocation of around $10 million for the 2024-2025 period to upgrade infrastructure in these settlements. Previous discussions described the necessity of not just approaching informal housing as a mere housing issue, but rather integrating it into a national development strategy that encompasses social and economic improvements.

The government’s proactive stance toward improving housing conditions underscores a hopeful trajectory toward sustainable community development, aiming for a future where all Fijians can access safe, dignified housing. Through collective efforts, reforms, and innovative solutions, the goal of transforming and enhancing the living conditions for those in informal settlements looks increasingly attainable.
