Fiji Takes First Steps Towards Constitutional Review

The Fijian government has initiated the process to review the 2013 Constitution following Cabinet approval for a Bill aimed at amending provisions in Chapter 11, which governs the procedure for constitutional amendments. This decision represents the first step toward what is anticipated to be a comprehensive evaluation of the Constitution, which has faced considerable criticism since its implementation.

To successfully amend the Constitution, a three-quarters majority vote from members of Parliament is required, followed by a national referendum where the same majority of registered voters must also be in favor of the change. This process underscores the significance of public involvement in governance.

Additionally, a Constitution Review Commission (CRC) is expected to be established to engage citizens in consultations regarding amendments to the Constitution. The government’s commitment to this review is reflected in a recent social media statement that acknowledges widespread critique concerning both the adoption process and the substantive contents of the 2013 Constitution.

The legislative agenda for 2025, which will detail the next steps, will be announced by the President during the opening of the upcoming parliamentary session next month.

This initiative aligns with the broader objectives outlined in the 2025-2029 National Development Plan (NDP), which emphasizes enhancing the legal framework and ensuring the rule of law, while promoting an independent judiciary and securing citizens’ rights. The NDP also calls for improved efficiency and transparency within law enforcement agencies, further demonstrating the government’s commitment to legal reform.

The review of the Constitution can be seen as a hopeful move towards strengthening democracy in Fiji, fostering greater participation in governance and ensuring that the legal frameworks in place serve all citizens equitably. Through active engagement and reform, Fiji can work towards reinforcing its democratic values and addressing longstanding concerns regarding the legitimacy and functionality of its Constitution.
