Fiji Law Society Urges Acting Director of Public Prosecutions to Resign

The Fiji Law Society is calling for the immediate resignation of Acting Director of Public Prosecutions, John Rabuku.

In a letter signed by FLS President Wylie Clarke, the society emphasized the need for Rabuku to step down and “demonstrate that he respects the laws of Fiji and the courts constituted under those laws.”

On June 28, 2024, the Supreme Court of Fiji delivered a unanimous opinion on a reference from the Cabinet under Section 91 of the Constitution. This case, a rare event where the Cabinet seeks guidance from the Supreme Court on a legal matter, underscores the importance of respecting the expertise of the judiciary.

The Supreme Court ruled that Rabuku was disqualified from serving as the acting Director of Public Prosecutions under the Constitution. Despite this clear opinion, the Fiji Law Society is deeply concerned that Rabuku continues to hold office.

Statements attributed to Rabuku in a local daily indicate that he will not resign and will instead await formal communication from the Cabinet or the Judicial Services Commission.
