The Fiji Law Society (FLS) has reached out to the Tribunal Chair overseeing the case of suspended Director of Public Prosecutions, Christopher Pryde, raising concerns regarding the proceedings. FLS President Wylie Clark emphasized an important question: Can the Tribunal continue its work without the presence of Pryde or his legal representation?

Clark highlighted that Pryde’s counsel withdrew due to financial constraints after his salary was suspended, raising questions about his right to procedural fairness as outlined in Section 16(1)(a) of the Constitution. He stated that while the Society is willing to assist the Tribunal as amicus curiae, they cannot accept a more active role in Pryde’s absence.

In their potential role as amicus curiae, the FLS would provide expert legal insights, present arguments relevant to the case, and discuss the broader implications of the proceedings. Clark noted that the Tribunal has requested clarification on how the term “misbehaviour” has been interpreted in other constitutional contexts. The Society is prepared to contribute to the discussion and will submit a focus paper on these issues.

This situation underscores the importance of ensuring fair legal representation in judicial processes. As the Tribunal navigates this complex case, the FLS’s commitment to providing legal expertise highlights a collaborative effort to uphold justice and procedural integrity in Fiji’s legal system.

In summary, the letter from the Fiji Law Society raises vital issues regarding procedural fairness and legal representation for the suspended DPP, while expressing the Society’s readiness to assist the Tribunal within defined limits. This cooperation could pave the way for a more comprehensive understanding of the legal matters at play, potentially contributing to a fair resolution of the case.
