Fiji Law Society Calls for Immediate Resignation of Acting Director of Public Prosecutions Following Supreme Court Ruling

The Fiji Law Society (FLS) has called for the Acting Director of Public Prosecutions, John Rabuku, to immediately step down from his post. The Society’s plea is centred around the expectation that Rabuku should display his respect towards Fijian laws and the courts that enforce them.

In a recent disclosure, Wylie Clarke, the President of the FLS, mentioned that the Supreme Court of Fiji had issued a unanimous verdict regarding a request from the Cabinet as per Section 91 of the Constitution. Clarke clarified that it is unusual for the Cabinet to seek legal guidance from the Supreme Court.

Clarke further stated that the Supreme Court concluded that Rabuku was ineligible for the post of acting Director of Public Prosecutions under the constitutional norms. This finding, coupled with Rabuku’s decision to remain in office despite the judgement, has stirred deep concerns within the FLS.

Quoting Rabuku’s statements published in the Fiji Sun, Clarke expressed disapproval of Rabuku’s refusal to resign. He emphasized the importance of obeying the law, particularly for high-ranking officials whose roles central to the administration of justice.

Clarke stressed that Rabuku should be aware of his obligations and act promptly to fulfill them by vacating his office. He added that the Society’s interest lies in ensuring that everyone including Rabuku abides by the law, reaffirming that there is no personal resentment against Rabuku.
