Fiji Law Society Calls for Immediate Resignation of Acting Director of Public Prosecutions

The Fiji Law Society (FLS) has called for the immediate resignation of Acting Director of Public Prosecutions, John Rabuku, emphasizing the importance of respecting the laws of Fiji and the rulings of its courts.

FLS President Wylie Clarke highlighted in a recent statement that the Supreme Court of Fiji had delivered a unanimous opinion on a legal reference from the Cabinet, under Section 91 of the Constitution. Clarke noted that such cases are rare and signify the Cabinet’s respect for the Supreme Court’s expertise in legal matters.

The Supreme Court determined that Rabuku was disqualified from his position under the Constitution. Despite this ruling, Rabuku has indicated he will not resign until he receives formal communication from either the Cabinet or the Judicial Service Commission, as reported in the Fiji Sun.

Clarke stressed that in a society governed by the rule of law, everyone, including high-ranking public officials like Rabuku, must adhere to it. He urged Rabuku to fulfill his duty by stepping down immediately, rather than waiting for an official process.

Clarke clarified that, akin to the situation with Justice Alipate Qetaki, whose appointment was upheld by the Supreme Court, the FLS holds no animosity towards Rabuku. The Society’s sole interest is ensuring that Rabuku, like all individuals in Fiji, complies with the law.
