Fiji Employers Raise Alarm Over Fast-Tracked Legislation Consultations

The Fiji Commerce & Employers Federation (FCEF) has expressed its concerns regarding the upcoming public consultations for two significant pieces of legislation: the Employment Relations Act 2007 and the Work Care Bill 2024. Scheduled to take place from January 8 to January 17, FCEF believes the time frame for submissions is unrealistic and could undermine meaningful public engagement.

CEO Edward Bernard highlighted that the lack of advance disclosure of the draft Bills would not only restrict the depth of discussions but could also shake investor confidence and hinder job opportunities. In a letter to the Permanent Secretary of the Ministry of Employment, Productivity & Workplace Relations, Bernard called for a postponement of the consultations to early February 2025. He argued that this delay would allow the public, workers, and businesses adequate time to prepare and participate effectively.

Bernard criticized the three-hour window allocated for each location, stating it is insufficient for municipal business networks to adequately represent their members. He pointed out that many businesses, particularly in the flood-affected Western Division, are still recovering and may struggle to prepare submissions in such a short period, especially right after the festive season. This rushed approach, he contended, could disadvantage workers, the business sector, and even the government as an employer.

Moreover, he noted that while the FCEF appreciates the Ministry’s efforts to facilitate national consultations, the Work Care Bill 2024 has not been reviewed by the Employment Relations Advisory Board (ERAB). As such, Bernard urged that the Bill be withdrawn until its draft is shared and discussed in the next ERAB meeting, ensuring all stakeholders have a say in the matter.

This proactive stance by the FCEF highlights the importance of thorough consultations in shaping labor legislation that truly reflects the needs of both workers and employers. By advocating for more time and transparency, there is an opportunity for a constructive dialogue that could ultimately benefit all parties involved, enhancing workplace relations and contributing to a sustainable economic recovery in Fiji.
