Fighting Corruption: The Urgent Call for Accountability

Attorney-General Graham Leung has cautioned Parliament against misusing the Fiji Independent Commission Against Corruption (FICAC) as a tool to target political opponents.

In his maiden speech, Leung emphasized, “That would be an abuse of power and unacceptable. Fiji is not a police or totalitarian state. Our long nightmare is over – there can be no returning to the dark days of tyranny where agents of the state arbitrarily targeted individuals who were perceived as obstacles to the government.”

Highlighting the unfinished business before FICAC, Leung stressed the urgency of holding individuals accountable for corruption, warning of its destabilizing potential and threat to the rule of law and economic development.

Leung urged FICAC staff to perform their duties lawfully, follow the evidence, and adhere to their constitutional mandate to prosecute those who have misappropriated public funds or abused their office for personal gain.

The Attorney-General underscored that FICAC is a constitutional body tasked with receiving, investigating, and prosecuting various crimes, including bribery and corruption. He reiterated that FICAC operates independently of any person or authority.

“So who is FICAC answerable to?” Leung queried. “Broadly speaking, FICAC is answerable to the law and the people of this country.”

Leung noted the need for strong and experienced leadership at FICAC, mentioning that the position of Commissioner of FICAC was recently advertised. He pointed out that some FICAC cases date back as far as 2014, with difficulties in securing court dates, and many cases stuck in the lengthy criminal lists awaiting their turn.

The Attorney General suggested the need to restore a dedicated ‘corruption court,’ indicating plans for close consultations with stakeholders to assess the justification for such a move. He highlighted that corruption and poor governance are security challenges that undermine democracy, the rule of law, and economic development.

Leung concluded by stating that FICAC must carry out their duties fearlessly, regardless of the difficulties or inconveniences, and follow the facts and evidence wherever they lead.
