The Fiji Independent Commission Against Corruption (FICAC) has concluded five significant investigations. The cases involved several high-profile figures, including former Attorney-General Aiyaz Sayed-Khaiyum, President Ratu Wiliame Katonivere, Minister for Sugar Charan Jeath Singh, former Supervisor of Elections Mohammed Saneem, and former Prime Minister Voreqe Bainimarama. These cases were initially referred by the current Supervisor of Elections, Ana Mataiciwa, earlier this year.
In a statement released yesterday, FICAC informed Ms. Mataiciwa that the investigations were closed on July 24.
Regarding Bainimarama, FICAC indicated that after their investigations and subsequent legal advice, there was insufficient evidence to support the allegations made by the complainant. The findings noted that, according to the Income Tax (Exempt Income) Regulation 2016, certain allowances received by Members of Parliament are exempt from taxation. However, it was also stated that the Income Tax Act does not consider allowances related to employees’ duties, including per diem allowances, as exempt.
In the case of Sayed-Khaiyum, the investigation determined that the Political Parties (Registration, Conduct, Funding and Disclosures) Act 2013 does not explicitly address what types of income political office holders are required to declare.
FICAC has recommended revisions to the Fijian Elections Office to enhance clarity and support during future investigations to prevent similar issues from arising. The Commission noted that for other matters referred by Ms. Mataiciwa, investigations are still ongoing, and no comments would be made until these are concluded.
FICAC reaffirmed its commitment to maintaining its usual operations and handling every complaint with the necessary diligence, regardless of the individuals involved.
