FICAC Closes High-Profile Corruption Cases: What’s Next?

The Fiji Independent Commission Against Corruption (FICAC) has concluded five significant cases involving high-profile figures. The individuals affected include former Attorney-General Aiyaz Sayed-Khaiyum, President Ratu Wiliame Katonivere, Minister for Sugar Charan Jeath Singh, former Supervisor of Elections Mohammed Saneem, and former Prime Minister Voreqe Bainimarama. These cases were referred to FICAC by Supervisor of Elections Ana Mataiciwa earlier this year.

In a statement released yesterday, FICAC informed Mataiciwa of the case closures on July 24.

Regarding Bainimarama’s case, FICAC determined that investigations, alongside a legal opinion, revealed insufficient evidence to substantiate the complainant’s claims. The commission noted that according to the Income Tax (Exempt Income) Regulation 2016 Schedule, allowances related to official duties for Members of Parliament are exempt. However, it clarified that the Income Tax Act specifies that allowances do not cover expenses tied to the performance of employment duties, which includes per diem allowances.

For Sayed-Khaiyum, the investigation revealed that the Political Parties (Registration, Conduct, Funding and Disclosures) Act 2013 did not clearly outline the income declarations required from political party office holders. FICAC has provided recommendations to the Fijian Elections Office to improve these areas to prevent similar issues in the future and to facilitate the investigation process.

FICAC stated that other matters referred by Mataiciwa are still ongoing, and no comments will be made until those investigations conclude. The commission emphasized its commitment to treating all complaints with the necessary diligence, regardless of the individuals involved.
