A 33-year-old father, who has been accused of raping his 12-year-old biological daughter earlier this year, is set to challenge the admissions he made during a caution interview. He appeared before Justice Pita Bulamainaivalu in Suva, facing two counts of rape and one count of sexual assault. In court, the accused pleaded not guilty to all charges.
The state lawyer, Yelena Sautu, informed the court that the prosecution intends to use the man’s admissions from the caution interview as evidence. However, the defense argues that the interview should be contested, asserting that the accused was not in the appropriate state of mind during the questioning.
The court has allowed the defense 21 days to file a voir dire, which will lead to a pre-trial conference scheduled for February 10 of next year. Additionally, a bail hearing will take place on December 9, with a ruling expected on December 13.
