A 49-year-old father of five has received a suspended sentence after being convicted of indecent assault against his niece. The sentence of 14 months and two weeks will see him spend six months and two weeks in custody, while the remaining eight months is suspended for three years.

The incidents took place during a family gathering in late November 2022, where the accused forcibly kissed his niece while she was washing dishes. In a separate incident, he was caught spying on her while she showered. The victim’s reactions during the incidents prompted her to call for help, and he fled the scene each time.

During the court proceedings, the accused expressed remorse for his actions and apologized to his niece and her mother, who were visibly affected. Magistrate Talei Kean emphasized the severity of the violation, particularly given the victim’s vulnerability and the trust expected within family dynamics. She highlighted the impact of the accused’s actions on both the complainant and her mother, who both cried in court as they confronted the painful reality of the situation.

Additionally, the court upheld a Domestic Violence Restraining Order against the man, which was initially issued in December 2022.
