A three-member Tribunal investigating allegations of misconduct against Christopher Pryde, the Director of Public Prosecutions (DPP), has reached a unanimous conclusion that the accusations were unfounded. The Tribunal recommended to President Ratu Naiqama Lalabalavu that Pryde should not be dismissed from his position.
Justice Anare Tuilevuka led the Tribunal, with Justice Chaitanya Lakshman and Justice Samuela Qica serving as members. They submitted their findings to the President on December 23, 2024. Following this, the President reviewed the report and consulted on its contents, commending the Tribunal for their diligent work and contribution to the nation.
Significantly, the Tribunal’s final report introduces crucial legal principles regarding the definition of “misbehaviour,” a term that lacked clear definition in the Constitution. This jurisprudence establishes a framework that will assist the Judicial Services Commission (JSC) in addressing complaints about judicial officers, including the DPP and other quasi-judicial officials.
The Tribunal also emphasized the need for guiding policies regarding the handling of complaints against judicial and quasi-judicial officers, advocating for clarity and consistency in decision-making in the absence of specific regulations.
In light of the Tribunal’s findings, President Lalabalavu has taken steps to reinstate Pryde. This includes the immediate effect of Pryde’s employment agreement with the government, the repayment of his unpaid salary and benefits, and facilitating Pryde’s return to his office along with the return of official items.
The Tribunal’s report will be made publicly available as per the provisions of the Constitution, allowing transparency in the findings.
