Court’s Concern: Legal Maneuvers Under Scrutiny in Deportation Case

The Court of Appeal has raised significant concerns regarding six individuals contesting their deportation to South Korea. The court noted that these individuals have been able to submit summonses in both the High Court and the Court of Appeal in a disorganized manner, without adhering to established court regulations.

President of the Court of Appeal Filimone Jitoko made these remarks on August 6 during a case involving members of Grace Road: Sung Jin Lee, Nam Suk Choi, Byeongjoon Lee, Beomseop Shin, Jung Yong Kim, and Jinsook Yoon. They were seeking court orders to declare the arrest and subsequent deportation of Byeongjoon Lee and Beomseop Shin on September 6, 2023, as unlawful.

Justice Jitoko criticized the appellants for neglecting to follow the appropriate appeal procedures outlined under High Court rules and for attempting to bypass the proper process to review the decisions made in the lower court.

He pointed out that the appellants requested direct intervention from the Court of Appeal through provisional measures for a re-hearing of the lower court’s decisions.

Ultimately, Justice Jitoko concluded that the summons filed by the appellants sought remedies already addressed by the previous court and are currently under appeal to both the Court of Appeal and the Supreme Court. He deemed the actions as an abuse of court processes, declaring the appellants’ summons to be without merit.
