Court Orders Traffic Authority to Refund $20,000 to Businessman

The Magistrate’s Court in Labasa has ruled in favor of businessman Sanjeev Reddy, ordering the Land Transport Authority (LTA) to refund $20,000 in fines he had paid due to Traffic Infringement Notices (TIN) issued against him. Magistrate Safaira Ratu presided over the case, where Reddy, supported by lawyer John Prasad, maintained that the fines were unjust.

Reddy originally faced three separate fines, including a $2,000 penalty for allowing someone to drive his vehicle with a non-compliant load. Subsequent fines amounted to $13,000 and $5,000. The cumulative impact of these fines forced Reddy to close his trucking business and shift to operating a shop for his livelihood.

In her ruling, Magistrate Ratu stated that upon reviewing the evidence presented by Reddy and the prosecution, the court found that the prosecution had not met the burden of proof necessary to uphold the fines. She also questioned the qualifications of one of the prosecution witnesses, ultimately leading to the dismissal of the TINs. She ordered the LTA to reimburse Reddy within a span of 21 days.

This ruling highlights the judicial system’s commitment to fairness and the importance of due process. It serves as a reminder of the rights individuals have when facing legal penalties and the necessity for authorities to substantiate their claims rigorously.
