Court Denies Former Accountant’s Travel Request Amid Ongoing Investigation

The Nadi Magistrate’s Court has denied former Fiji Institute of Accountants president Zarin Khan’s request to lift a stop departure order. This order, placed by FICAC Commissioner Barbara Malimali, was enacted last year as part of an ongoing investigation by the Fiji Independent Commission Against Corruption (FICAC).

Mr. Khan requested the court’s intervention to lift the order, citing medical travel needs. However, Magistrate Semi Babitu upheld the legitimacy of the stop departure order, affirming that Commissioner Malimali acted within her rights under section 13 (1) (e) of the FICAC Act 2007. He stated that the court lacks the jurisdiction to challenge this matter, leaving Mr. Khan with a 28-day window to appeal the ruling.

This decision highlights the legal framework in place to address corruption concerns in Fiji, reflecting the judiciary’s commitment to upholding the law. While the denial may be frustrating for Mr. Khan, it serves as a reminder of the importance of due process in investigations.

In a broader sense, the integrity of institutions like FICAC is vital for fostering public trust and ensuring accountability, which is essential for any society looking to combat corruption effectively.

Summary: Zarin Khan’s plea to lift his stop departure order was rejected by the Nadi Magistrate’s Court, emphasizing the legal authority of FICAC in corruption investigations. He can appeal the decision within 28 days.
