Court Confronts Crisis: Prosecution’s Case File Catastrophe

The police prosecutions department is grappling with significant challenges regarding its case file management system and the lack of designated officers to manage these cases effectively. This situation was highlighted by Inspector Joshua Shaw during a court session led by Magistrate Yogesh Prasad, where prosecutors were observed arriving without the necessary case files.

The incident centered around the case of two 20-year-old men, Iliesa Rokoulu and Thomas Benjamin, who admitted to criminally trespassing to gather coconuts from another person’s property. The court was prepared to hear a summary of the facts related to the case, but Inspector Shaw indicated that the details were still being finalized for presentation.

Magistrate Prasad acknowledged that the inadequacies of the current case file management were not the fault of Inspector Shaw but pointed out that systemic changes are necessary. He commended a new case management system recently introduced by Acting Chief Justice Salesi Temo, which has been effective in resolving older cases. To address the existing issues with case files, Magistrate Prasad suggested recruiting new personnel from the academy or establishing a dedicated research team to assist the prosecution.

Eventually, the necessary summary of facts was submitted, and both Rokoulu and Benjamin were discharged without conviction.

This situation underscores the need for reform within the prosecutorial processes to enhance efficiency and resource allocation. It is hopeful that with proposed changes and the introduction of new recruits, the prosecution department can improve its operations, ultimately benefiting the judicial system as a whole.
