Lawyers for the Fiji Independent Commission Against Corruption (FICAC) and Sarika Devi Raj, a former finance officer of the Republic of Fiji Military Forces (RFMF), received an extension to address critical disclosure issues in Raj’s ongoing legal case. This decision was made during a recent court session at the Suva Magistrate’s Court, where Raj sought to modify her bail conditions, particularly to eliminate the requirement for regular reporting to the FICAC office.
Raj faces serious allegations that from September 20, 2019, to June 19, 2020, she engaged in actions leading to an improper financial gain of $182,404.99. It is claimed that she failed to declare her ownership of Maleka Investment, a vendor for RFMF, which potentially jeopardized the organization’s interests.
During the proceedings, Raj’s attorney, Mohammed Saneem, argued that FICAC misled the court regarding the execution of a search warrant and noted that some relevant documents requested by the RFMF legal director were not adequately provided. He raised pivotal concerns regarding the authority in this case, questioning whether the RFMF or the court holds precedence.
In response, FICAC lawyer Lavinia Ravuikadavu refuted the claims of misleading the court and clarified that while FICAC managed the search warrant, they require specific document requests due to a large number of manuals and instructions (over 150) held by the RFMF. Ravuikadavu indicated that this information was previously communicated via a letter on December 17, 2024.
Magistrate Pulekeria Low stressed the importance of FICAC providing the necessary documents, given their role as the charging entity in this case. Saneem was granted 14 days to submit a further application for the requested documents, after which FICAC will have an additional 14 days to respond. Both parties are set to reconvene in court on January 23.
