Confusion Cleared: Fiji Corrections Service Explains Inmate Early Release System

The Fiji Corrections Service has announced that inmates can be released early through remission and parole. This clarification comes amidst confusion regarding early release from rehabilitation centers.

Remission refers to the shortening of an inmate’s sentence due to good behavior, as per the Corrections Service Act 2006. The Commissioner of Corrections has the authority to reduce a prisoner’s sentence by one-third for good conduct.

Parole allows an inmate to be released before completing their full sentence, provided they regularly report to a supervising officer and maintain good behavior. The Parole Board, established by the Corrections Service Act 2006, decides on parole releases.

The Fiji Corrections Service highlighted the confusion concerning the interplay between remission and parole. This stems from the interpretation of Section 27(4) of the law, which states that inmates must serve the full non-parole period set by the court. The Supreme Court clarified that while this non-parole period limits the Parole Board’s ability to release inmates early, it does not affect the Commissioner’s power to grant remission.

The recommendation to remove Section 27(4) from the Corrections Service Act 2006 aims to clarify the rules surrounding remission and parole. This change is intended to make the system clearer and more understandable for everyone involved.

The Fiji Corrections Service reiterated that this change will enhance fairness and transparency within the correctional system, ultimately benefiting both inmates and the institution.
