Bail Withdrawal Shocks As Rape Case Develops

An unemployed man facing allegations of raping his wife has decided to withdraw his third application for bail. The 35-year-old, who is married with two children, appeared in front of Justice Pita Bulamainaivalu, where he faces charges of both rape and assault. The incident reportedly took place on July 15 last year, during which it is alleged that the man attacked his 43-year-old wife in the presence of their children.

Due to a scheduling conflict, the trial originally set for January 27 to 31 next year has been postponed, as Justice Bulamainaivalu is tied up with another trial in Labasa for a month. During the court proceedings, State lawyer Zenith Zunaid mentioned minor issues related to the admitted facts that need to be revised. Consequently, Justice Bulamainaivalu instructed both parties to engage in discussions regarding these issues before the next court date.

Despite the ongoing legal challenges, the accused’s Legal Aid lawyer informed the court that he wishes to withdraw his current bail application. As it stands, he remains in custody, with the case scheduled to reconvene on December 12.
