Bail Hearing Delayed: Aiyaz Sayed-Khaiyum’s Travel Plans in Limbo

The State Prosecution has been granted an additional day to finalize its response to the bail variation request made by former Attorney-General Aiyaz Sayed-Khaiyum. Sayed-Khaiyum appeared before Magistrate Sufia Hamza at the Suva Magistrate’s Court, seeking permission to travel abroad for a medical review.

During the proceedings, State Prosecutor Unaisi Ratukalou informed the court that they required more time to consult with two urologists regarding the medical procedures available locally. Defense lawyer Devanesh Sharma expressed concerns about the delays, noting that a similar request for time had previously been made by acting assistant director of Public Prosecution Laisani Tabuakuro on July 15.

Sharma questioned the State’s approach to obtaining affiants for their submissions, emphasizing the urgency of the matter and criticizing the ongoing adjournments. In the last session, it was noted that the State was expected to present an Investigation officer as a witness.

Magistrate Hamza expressed disappointment with the State’s request and indicated that the delays were hindering the defendant’s right to a fair process, as additional time would be needed for the defense to respond to the forthcoming affidavit. The court permitted the State to submit their findings by the end of business yesterday, and another session is scheduled for today at 12 PM to continue the bail hearing. The substantive issues related to this case had already been addressed earlier in the day by Magistrate Yogesh Prasad.
