Bail Denied: Aiyaz Sayed-Khaiyum’s Overseas Travel Request Rejected

The Magistrates Court in Suva has denied a bail variation request from former Attorney-General Aiyaz Sayed-Khaiyum, which sought permission for him to travel abroad for medical evaluation.

Resident Magistrate Sufia Hamza, in her decision, pointed out that Sayed-Khaiyum had previously received treatment for heart and kidney issues in Singapore. Dr. Sireli Kaloucava, one of the two urology specialists in Fiji, verified that follow-up care could be adequately provided in Fiji.

Citing relevant legal precedents, Magistrate Hamza referenced the case of Arts v State 2017 FJHC 27; HAM 204.2016, noting that it is the applicant’s responsibility to demonstrate to the court the existence of extraordinary and compelling circumstances that warrant altering bail conditions. She emphasized that such factors should either be new or not previously reviewed by the court at the time of setting those conditions.

Additionally, she mentioned the case of Qarase v Fiji Independent Commission Against Corruption 2009 FJHC 146; HAC 038.2009 2009, in which Justice Goundar highlighted that ensuring the accused’s presence at hearings is a crucial consideration, along with the purpose and duration of the overseas visit, and the potential disruption to the judicial process.

Sayed-Khaiyum is facing six charges of abuse of office, along with seven counts of obstructing justice, as defined by the Crimes Act. Magistrate Hamza noted that this is a continued legal matter involving serious allegations against him.

Sayed-Khaiyum was absent from court proceedings today. The case is scheduled to resume on September 3 for further mention.
