Australia’s New Visa to Safeguard Overseas Workers: What to Know!

Australia has introduced an innovative workplace justice visa designed to safeguard foreign workers from unfair treatment. Maretino Nemani, the permanent secretary for the Employment Ministry, highlighted that this initiative aims to tackle the issue of workers being repatriated for minor infractions without fair process.

Previously, workers could be sent home instantly at their employer’s discretion, causing considerable emotional distress for families, especially for children who depend on remittances for their education and well-being. Mr. Nemani stated, “The justice visa will ensure that Fijian workers, Vanuatu workers, Samoans, Solomon Islanders, and workers from the Liberation Union countries cannot be immediately sent home for misdemeanours. This is not justice, and due process must be followed.”

The new justice visa establishes that such behaviors will no longer be accepted and mandates that due process must occur before any worker is repatriated. He added that the Department of Employment and Workplace Relations in Australia will be responsible for finding new employment for workers involved until their cases are resolved. This process is referred to as redeployment.

The justice visa will enable workers mistreated by employers to remain in Australia while the Department of Employment seeks to place them with another employer. Mr. Nemani explained that the introduction of this visa is part of a broader initiative to improve the treatment of foreign workers and acknowledge the effects of labor mobility on families.

He emphasized that effective collaboration and constant communication with Australian authorities have been vital in facilitating these reforms. “If workers are not treated well, it can lead to disengagement. We recognize the impact on children left behind, but workers must be treated with dignity. If they are not valued and become disengaged, it affects the financial support sent back home, ultimately undermining the very purpose of their migration.”
