Attorney General Graham Leung has recently concluded his testimony before the Commission of Inquiry regarding the appointment of Barbara Malimali as the new Commissioner of the Fiji Independent Commission Against Corruption (FICAC). While speaking to the media, Mr. Leung stated that all witnesses, including himself, have been instructed not to disclose any details of their evidence during the inquiry. He did, however, express confidence in the fairness of the appointment process.

Janet Mason, a senior barrister questioning involved witnesses, described Mr. Leung’s questioning as “straightforward and fast,” signifying a contrast to previous testimonies. She clarified that the appointment of the FICAC commissioner requires consultations with the Attorney General, highlighting Mr. Leung’s constitutional role in recommending candidates.

Notably, prior to his testimony, Mr. Leung defended Malimali’s appointment, asserting that she was selected based on merit after a competitive process involving other candidates. Despite this, it’s essential to note that Malimali is currently under investigation by FICAC. Coincidentally, on the day of her appointment, Malimali faced an alarming situation when she was detained by her own staff concerning allegations of abuse of office.

Leung expressed concern over the circumstances, emphasizing that it is unprecedented for a newly appointed commissioner to be detained on her first day. He indicated that the powers of FICAC should be exercised with utmost caution, considering their potential impact on an individual’s liberties and reputations.

In light of the progressing inquiry and the serious nature of the events surrounding Malimali’s appointment, the examination of FICAC officials is nearing its conclusion. Following this, Reginald Jokhan from the Electoral Commission is expected to take the stand.

Overall, this situation illustrates the complexities surrounding the governance of integrity in Fiji, emphasizing the importance of transparent procedures and accountability in public office. The unfolding events, while concerning, also present an opportunity to ensure robust mechanisms are in place to address any allegations of misconduct effectively and uphold the integrity of FICAC and its leadership.

This inquiry marks a pivotal moment in Fiji’s efforts to enhance standards of governance and integrity, with hopes that thorough investigations will lead to a stronger focus on accountability, ultimately fostering public trust in institutions.
